Abstract

The importance of access to legal representation for refugees and asylum seekers within the criminal justice system is undeniable. This article, employing a descriptive and analytical method and based on a review of library-based sources, explores the barriers and challenges present in this area. The primary aim of the research is to identify the factors that hinder effective access to legal services for these groups. The findings reveal that major challenges include legal discontinuities, language barriers, lack of awareness regarding legal rights and responsibilities, and financial constraints, all of which often prevent refugees and asylum seekers from adequately defending their rights. Furthermore, insufficient knowledge about legal procedures and the absence of social support also exacerbate this condition. Enhancing governmental support, providing legal professionals and attorneys with training in refugee law, and offering translation services can help mitigate linguistic and legal barriers, and by facilitating access to justice, strengthen the protection of human rights and legal security for these vulnerable populations.
