Analysis of the Liability of the ʿĀqilah in Relation to the Acceptance of the Principle of Non-Contractual Civil Liability Arising from the Act of Another

Abstract

In some cases, following Islamic jurisprudence, positive law imposes liability on the ʿāqilah, relatives, or ultimately the public treasury. Some scholars regard this form of liability as contrary to the principle of the personal nature of liability and, accordingly, have either opposed these institutions or treated them as exceptional. However, an analysis of the nature of liability in these institutions shows that such liability is a form of non-contractual civil liability. Moreover, in the laws of some countries, civil liability arising from the act of another has become an established principle. Although the legislator, in the Islamic Penal Code enacted in 2013, has confused the foundations and effects of the liability of the ʿāqilah with the liability of relatives, explaining the foundations of the civil liability of the ʿāqilah can contribute to the acceptance of the principle of non-contractual, and even contractual, civil liability in the Iranian legal system, which will be addressed in this study.
