مسئولیت كیفرى ناشئ از جرائم ارتكابى به وسیله ربات‌ها

عصر جدید عصر فناورانه است که همه ابعاد زندگی را تحت تاثیر خودش قرار داده است. در این حوزه ربات‌ها و هوش مصنوعی ظهور پیدا کرده اند که توامان دارای فرصت‌ها و چالش‌هایی است. یکی از این چالش‌ها مباحث حقوقی و قضایی مربوط به ربات و هوش مصنوعی است. بر این اساس، هدف این مطالعه، مسئولیت كیفرى ناشئ از جرائم ارتكابى به وسیله ربات‌ها است. مطالعه حاضر با روش تحلیلی در صدد مطالعه موضوع است. نتایج مؤید این است که قوانین و هنجارهای سنتی حقوقی و قضایی پاسخگوی جرائم ارتکابی به وسیله ربات‌ها نیست. زیرا، الگوی فعلی و سنتی جرم که بر پایه عناصر مادی و معنوی استوار است، قادر به درک ماهیت منحصربه‌فرد و متفاوت ربات‌هایی نیست که از توانایی تصمیم‌گیری مستقل برخوردارند؛ این امر مستلزم بازسازی کامل نگاه نظری به جرم‌شناسی نه صرفاً اصلاح در متون قانونی موجود است. همچنین، فقدان مرز مشخص میان خطای کیفری، خطای فنی و خطای صنعتی در جرایم مرتبط با ربات‌ها، نیازمند توسعه الگوهای جدیدی از مسئولیت است که ترکیبی از مسئولیت کیفری و فنی را در بر گیرد. از سویی دیگر، امکان ایجاد مفهوم شخصیت حقوقی یا شخصیت اعتباری برای ربات‌ها تحت شرایط سخت‌گیرانه وجود دارد. بر این اساس، ضروری است که قواعد حقوقی جدیدی تدوین شود که ضمن تعریف روشن از مفهوم مسئولیت مشترک، نقش هریک از طراحان، توسعه‌دهندگان و کاربران را در این زمینه مورد توجه قرار دهد، و این همان محور اصلی این پژوهش است.
