نقش الگوی ذهنی قضات دیوان بین‌المللی دادگستری در توسعه رویه‌های زیست محیطی بین‌المللی: مطالعه موردی پروژه گابچیکوو–ناگیماروش

تحولات اخیر در عرصه حقوق بین‌الملل محیط زیست، نقش دیوان بین‌المللی دادگستری را در تبیین و توسعه اصول زیست محیطی بیش از پیش برجسته ساخته است. یکی از مهم‌ترین جلوه‌های این تحول را می‌توان در رأی دیوان در پرونده گابچیکوو–ناگیماروش مشاهده کرد؛ رأیی که در آن قضات با استناد به اصول نوین از جمله توسعه پایدار، حسن نیت، و همکاری، رویکردی فراتر از تفسیر صرف متن معاهدات در پیش گرفتند. این مقاله با تمرکز بر الگوی ذهنی قضات، به بررسی نحوه تأثیر پیش‌زمینه‌های حقوقی، تفسیری و فلسفی آنان بر تصمیم‌گیری قضایی در این پرونده می‌پردازد. یافته‌های مقاله نشان می‌دهد که دیوان از رهگذر تلفیق معیارهای حقوقی سنتی با مقتضیات نو پدید زیست محیطی، توانسته است به‌صورت تدریجی به توسعه هنجارهای محیط‌زیست بین‌المللی کمک کند. استفاده از تفسیر هدفمند و سیستماتیک، ارجاع به اصول کلی حقوقی، و توجه به ملاحظات بین‌المللی روز، مؤید حضور یک الگوی ذهنی پویا و تأثیرگذار در فرایند رأی‌سازی قضات است.
