Judicial Review of Government Regulations (Bylaws and Cabinet Resolutions) and Its Role in Ensuring the Effectiveness of the Rule of Law, Remedies for Violations, and Judicial Security

Judicial review of government regulations, particularly bylaws and cabinet resolutions, constitutes one of the most fundamental mechanisms for establishing a balance between the public interest and citizens’ fundamental rights and functions as the ultimate guarantor of the rule of law. The present study aims to assess the role of such review in ensuring the effectiveness of the rule of law, activating remedies for violations, and consolidating judicial security within the legal system of the Islamic Republic of Iran. The study employs an analytical-comparative method, drawing on the theoretical foundations of the hierarchy of norms and comparisons with leading legal systems. The findings indicate that judicial review is not a secondary mechanism but rather a structural necessity for realizing the rule of law and safeguarding individuals’ acquired rights, and that its effectiveness depends on the independence of administrative adjudicatory institutions, the substantive depth of judicial scrutiny, and the expeditiousness of proceedings. The principal challenges to such effectiveness include the predominance of a formalistic approach to adjudication, limitations on the retroactive application of remedies, and the congestion and excessive duration of judicial proceedings, all of which undermine judicial security. The article concludes that a transition toward substantive review, the broader application of retroactive annulment, and the acceleration and enhanced transparency of judicial procedures constitute the three fundamental pillars for ensuring the effectiveness of the rule of law and providing effective remedies for violations.
