نظریه حاکمیت ملی در قانون اساسی در پرتو بایسته‌های نظام حقوق بین‌الملل

یکی از اساسی‌ترین موضوعات حقوق اساسی «حاکمیت» است. در این پژوهش که به صورت توصیفی – تحلیلی صورت گرفته است، «حاکمیت ملی» به عنوان یکی از زیرشاخه‌های بحث حاکمیت انتخاب شده و جایگاه آن در قانون اساسی جمهوری اسلامی ایران مورد بررسی و واکاوی قرار گرفته است. هدف از این پژوهش پاسخ به این پرسش هاست که مبانی حاکمیت در نظام حقوقی اسلام ناب چیست؟ قانون اساسی جمهوری اسلامی ایران چه نوع حاکمیتی را پذیرفته است؟ حاکمیت مردم و حاکمیت دین چگونه با هم سازگاری دارد؟ آیا مردم مشروعیت بخش به حاکمیت در نظام جمهوری اسلامی‌اند یا خیر؟ انتخابات به عنوان اصل تغییرناپذیر چه اثری در حاکمیت دارد؟ آیا حاکمیت متعلق به خداست؟ آیا حاکمیت متعلق به مردم است؟ آیا حاکمیت متعلق به ولی فقیه است؟ رأی اکثریت و رأی ولی فقیه در حکومت ولایی چگونه با هم سازگاری دارند؟ یافته‌های پژوهش نشان می‌دهد رفراندوم و همه پرسی (اصل ٥٩)، انتخاب رهبر و ولی فقیه (اصل ۱۰۷) به صورت دو درجه‌ای، انتخاب رئیس جمهور (اصل ١١٤ و ١١٧)، انتخاب نمایندگان مجلس شورای اسلامی (اصل ٥٨ و (٦٢)، انتخاب اعضای شوراهای محلی (اصل ۷ و ۱۰۰)، انتخاب نمایندگان مجلس خبرگان رهبری (اصل ۱۰۸) و تأیید یا عدم تأیید مصوبات شورای بازنگری قانون اساسی (اصل ۱۷۷) از جلوه‌های حاکمیت ملی در قانون اساسی به شمار می‌روند.
