کارکرد هوش مصنوعی در قضاوت با رویکردی بر فقه

با گسترش سامانههای هوشمند، امکان تحلیل دادهها و پیشنهاد تصمیم در فرایند قضاوت مطرح شده است، اما جایگاه قاضیِ انسان و معیارهای شرعیِ علم، عدالت و مسئولیتپذیری در فقه چگونه بر این تحول انطباق مییابد؟ سؤال اصلی این است که کارکرد هوش مصنوعی در قضاوت از منظر فقهی تا چه حد پذیرفتنی است و چه حدودی دارد؟ تحقیق حاضر با روش توصیفی – تحلیلی به این نتیجه دست یافته است که بر اساس ادله فقهی، هوش مصنوعی به عنوان قاضی مستقل جایگاهی ندارد، اما میتواند به عنوان دستیار قضایی تحت نظارت قاضی انسان، نقشی تسهیلگر داشته باشد. برای مواجهه با تحولات آینده، فقه امامیه باید با بازتعریف مفاهیم بنیادین و تقویت پژوهشهای بینرشتهای، ضمن تدوین ضوابط اخلاقی و حقوقی دقیق، از این فناوری به مثابه بستری برای تحقق عینیتر عدالت و ادای مسئولیتهای شرعی در راستای آرمانهای متعالی اسلامی بهره گیرد.
