توسعه حقوقی مفهوم «جرایم علیه بشریت» و «جنایت جنگی» در پرتو جنگ غزه و پیگرد حقوقی اسرائیل

در پی وقوع جنایات گسترده رژیم صهیونیستی پس از رویداد ۷ اکتبر و حملات آن به نوار غزه و جنوب لبنان، نگرانی‌های عمیقی از منظر حقوق بین‌الملل مطرح شده است؛ نگرانی‌هایی که ناظر بر چگونگی پیشگیری از چنین جنایاتی و بهره‌گیری مؤثر از ظرفیت‌های نهادهای فراملی در راستای تحقق عدالت بین‌المللی می‌باشد. از این‌رو، پژوهش حاضر که با رویکردی توصیفی ـ تحلیلی تدوین شده به بررسی امکان توسعه حقوقی مفهوم جرایم علیه بشریت و جنایت جنگی در پرتو جنگ غزه برای امکان و فرصت پیگرد حقوقی اسرائیل است و به ابعاد حقوقی جنایات ارتکابی توسط رژیم اشغالگر صهیونیستی در سرزمین‌های اشغالی فلسطین و لبنان، به‌ویژه در جریان حملات اخیر به غزه، می‌پردازد. هدف اصلی این مطالعه، ارایه راهکارهایی برای انطباق رفتار رژیم صهیونیستی با جرایم علیه بشریت و جنایت جنگی در غزه از طریق توسعه حقوقی مفهوم این جرایم بین‌المللی است. نتایج پژوهش نشان می‌دهد که بخش عمده‌ای از اقدامات نظامی و غیرنظامی رژیم اسرائیل پس از حمله ۷ اکتبر، با تعاریف مندرج در اساسنامه دیوان بین‌المللی کیفری در خصوص جنایات جنگی و جنایات علیه بشریت انطباق دارد و از حیث حقوقی، قابلیت پیگرد و رسیدگی در چارچوب دیوان را داراست.
