Abstract

Citizens’ rights, as one of the fundamental components of good governance, reflect the quality of the relationship between public authority and members of society. In Iran’s legal system, the Ministry of Justice, due to its distinctive position at the interface between the executive and judicial branches, possesses significant institutional capacity to safeguard citizens’ rights. Nevertheless, ambiguity regarding its competencies, the lack of proportionality between responsibilities and powers, the fragmentation of duties among multiple institutions, and weaknesses in coordination and oversight mechanisms have created substantial challenges for the Ministry in fulfilling this role. Using a descriptive-analytical method, this study aims to evaluate the effectiveness of the Ministry of Justice, identify institutional deficiencies affecting its performance, and propose strategies for strengthening its role in the realization and protection of citizens’ rights. The findings indicate that, despite existing legal and institutional capacities, challenges such as ambiguity in competencies, the Ministry of Justice’s dual institutional position, the fragmentation of responsibilities among competent authorities, weak inter-institutional coordination, and deficiencies in oversight and accountability systems constitute major obstacles to the effective performance of the Ministry. Strengthening its role requires redefining the Ministry of Justice as a coordinating and policymaking institution, reforming the relevant legal framework, establishing effective coordination mechanisms, developing monitoring and evaluation systems, and utilizing the capacities of modern governance.
