Abstract

The subdivision of urban lands is one of the critical issues in the field of urban development and land management that faces numerous challenges. These challenges include legal and cadastral conflicts, regulations and requirements of comprehensive and detailed urban plans, property rights and governmental expropriation, subdivision rules and regulations, executive challenges, and uncertainty in local laws. This article examines these challenges and emphasizes the importance of compliance with laws and regulations related to the subdivision of urban lands, as well as the necessity of an appropriate judicial practice for resolving conflicts and disputes. In addition, the importance of comprehensive and coordinated policies aimed at improving related laws and regulations, increasing transparency and certainty in land subdivision processes, and establishing appropriate mechanisms for conflict and dispute resolution has been highlighted. Considering this issue, the present study investigates the challenges facing the subdivision of urban lands in laws and regulations with emphasis on judicial practice through a descriptive–analytical method and library-based research approach. The findings of the study indicate that achieving a process of urban land subdivision that is both lawful and equitable requires cooperation among governmental organizations, municipalities, and landowners.
