These challenges include legal and cadastral conflicts, regulations and requirements of comprehensive and detailed urban plans, property rights and governmental expropriation, subdivision rules and regulations, executive challenges, and uncertainty in local laws. This article examines these challenges and emphasizes the importance of compliance with laws and regulations related to the subdivision of urban lands, as well as the necessity of an appropriate judicial practice for resolving conflicts and disputes. In addition, the importance of comprehensive and coordinated policies aimed at improving related laws and regulations, increasing transparency and certainty in land subdivision processes, and establishing appropriate mechanisms for conflict and dispute resolution has been highlighted. Considering this issue, the present study investigates the challenges facing the subdivision of urban lands in laws and regulations with emphasis on judicial practice through a descriptive–analytical method and library-based research approach. The findings of the study indicate that achieving a process of urban land subdivision that is both lawful and equitable requires cooperation among governmental organizations, municipalities, and landowners.</p> <p>تفکیک اراضی شهری یکی از موضوعات حیاتی در زمینه توسعه شهری و مدیریت اراضی است که با چالش‌های متعددی مواجه است. این چالش‌ها شامل تعارضات حقوقی و ثبتی، ضوابط و مقررات طرح‌های جامع و تفصیلی، حقوق مالکانه و تملک دولتی، ضوابط و مقررات تفکیک اراضی، چالش‌های اجرایی و عدم اطمینان در قوانین محلی است. این مقاله به بررسی این چالش‌ها و اهمیت رعایت قوانین و مقررات مربوط به تفکیک اراضی شهری پرداخته و نیاز به یک رویه قضایی مناسب برای حل تضادها و تعارضات را تاکید کرده است. به علاوه، اهمیت سیاست‌های جامع و هماهنگ برای بهبود قوانین و مقررات مرتبط، افزایش شفافیت و اطمینان در فرآیندهای تفکیک اراضی و ایجاد مکانیزم‌های مناسب برای حل تضادها و تعارضات برجسته شده است. با در نظر گرفتن این مسئله، به بررسی چالش‌های فراروی تفکیک اراضی شهری در قوانین و مقررات با تکیه بر رویه قضایی با روش تحلیلی – توصیفی و به صورت کتابخانه ای پرداخته می شود. یافته‌های تحقیق نشان می دهد که  برای دستیابی به یک فرآیند تفکیک اراضی شهری که هم قانونی و هم عادلانه باشد، همکاری بین سازمان‌های دولتی، شهرداری‌ها و مالکان اراضی ضروری است.</p> https://jecjl.com/index.php/jecjl/article/download/553/418
