Strategies for Empowering Differential Policy in the Enforcement of Sentences for Juvenile Offenders

Abstract

Differential criminal policy, which refers to the adoption of distinct and appropriate criminal strategies tailored to different offenders, has been institutionalized and enhanced within legal systems. The present article, which is the result of extensive research, was conducted with the objective of examining the extent of applying the capacities of differential criminal policy to juvenile delinquency, with a particular focus on the enforcement of criminal sentences in Iranian law, using a descriptive–analytical method. The study aims to argue for responsive approaches to juvenile delinquency and to employ rehabilitative criminal strategies for crime prevention through differential criminal policy. To achieve this, it is necessary to define and clarify the strategies that empower differential criminal policy in the enforcement of sentences for juvenile offenders. The findings indicate that, in the Iranian legal system, substantive and procedural laws and regulations embodying differential criminal policy toward juvenile delinquency have enhanced the functional efficiency of the judiciary by increasing effectiveness in crime control and prevention, as well as in social rehabilitation and reintegration. Moreover, given the assumption of deficiencies arising from the lack of awareness among executive authorities during the enforcement stage of juvenile sentences, strategies such as the establishment of juvenile justice boards, the creation of local commissions at the enforcement stage, the strengthening of positive perspectives toward NGOs during the enforcement of juvenile sentences, and the possibility of unlimited review of prior decisions, eliminate restrictions and create empowerment of differential criminal policy in the enforcement stage for juvenile offenders.
