Criminal Liability in Child Marriage: The Role of Parents and Intermediaries

Child marriage is one of the most complex socio-legal issues, with deeply adverse effects on the rights and physical and psychological well-being of children. This phenomenon often results from intricate interactions among legal frameworks, social and cultural norms, economic conditions, and the influence of parents. The aim of this study is to examine the criminal responsibility of parents and intermediaries involved in child marriage. Accordingly, this article employs an interpretive-analytical method to explore the subject. Findings indicate that reducing the incidence of child marriage requires a comprehensive and multifaceted approach that simultaneously addresses legal reform, public education, and cultural transformation. Existing laws must be revised to raise the legal age of marriage to a level at which children are mentally and psychologically prepared to assume the responsibilities of marriage. In this context, all legal exceptions that permit the marriage of children must be eliminated, and stricter penalties must be enacted for those who participate in this process. Moreover, it is essential to design educational programs for parents and judicial authorities to raise their awareness of the harms caused by child marriage and the rights of children. In parallel, promoting a culture of respect for children's rights and establishing positive models of marriage at older ages can significantly influence cultural attitudes toward early marriage. Finally, collaboration with non-governmental organizations and the development of vocational skills for both girls and boys can help prevent early marriages and prepare young individuals for an independent future based on informed personal choices.
