The Validity of Official Documents in the Framework of the Principles of the Rule of Law

Official documents, as an important tool in recording and proving legal relations, play a fundamental role in promoting legal stability and predictability. This research, using an analytical-comparative approach, examines the link between the validity of official documents and the principles of the rule of law. The main goal is to identify the characteristics of official documents, their function in ensuring legal transparency and justice, and to identify theoretical and practical obstacles to their validity. The research method is based on the study of books, scientific articles, and up-to-date legal sources in a descriptive-analytical manner. The findings show that official documents, with their special legal authority and inherent validity, establish the rights of the parties and guarantee the legal outcome of transactions. On the other hand, challenges such as forgery, the role of limited observers, and the lack of coordination of information technology can affect the good citation of these documents. The comparative analysis states that in the French system, the role of notaries and the power to immediately execute documents add to the depth of trust, while in the English system, although there is no institution equivalent to public documents, the validity of contracts is achieved through different mechanisms such as registration in the land registry. The conclusion of the article is that the validity of public documents, as a legal arm of the rule of law, requires executive, supervisory and technological support. It is suggested that by utilizing new technologies and strengthening supervision and education, the obstacles ahead can be removed and greater legal stability can be ensured.
