چالش های هوش مصنوعی در حل و فصل اختلافات تجاری بین المللی؛ با تاکید بر تعامل مشترک انسان و ماشین در فرآیند تصمیم گیری

با پیشرفت فناوری، هوش مصنوعی به عنوان ابزاری نوین در حل و فصل اختلافات تجاری بین المللی مطرح شده است. این فناوری می تواند با تحلیل سریع و دقیق داده ها، پیش بینی نتایج دعاوی و ارائه پیشنهادات موثر، کارایی فرآیندهای حقوقی را افزایش دهد. با وجود مزایای متعدد هوش مصنوعی نباید از نظر دور داشت که گسترش و پیشرفت این فناوری به دلیل پیامدهای نامعلوم همراه با خطراتی است. از این رو، در کنار تمامی دستاوردهای مثبت، این فناوری می تواند زمینه ساز چالش هایی در حوزه تجارت بین الملل شود. پژوهش حاضر به بررسی این پرسش می پردازد که چه چالش های حقوقی و عملی در به کارگیری هوش مصنوعی در فرآیند حل و فصل اختلافات بین المللی وجود دارد؟ به نظر می رسد، چالش هایی مانند شفافیت تصمیم گیری، سوگیری و تبعیض پذیری، دسترسی به اطلاعات صحیح، حفظ حریم شخصی و ... وجود دارند که نیازمند توجه و بررسی دقیق هستند. تعامل مشترک انسان و هوش مصنوعی می تواند با ترکیب قابلیت های هوش مصنوعی و هوش انسانی بر محدودیت ها و چالش های بعضا یک جانبه گرایانه هوش مصنوعی غلبه کرده و فرآیند تصمیم گیری را بهبود ببخشد. هدف اصلی این پژوهش بررسی چالش ها و مسائل حقوقی مرتبط با کارکردهای هوش مصنوعی در روند حل و فصل اختلافات است. در این راستا، با استفاده از شیوه های توصیفی-تحلیلی و با بهره گیری از روش های مطالعات کتابخانه ای تلاش می شود که به تحلیل جامع و دقیق جنبه های حقوقی موضوع پرداخته شود.
