ثبت ارقام گیاهی و سلامت غذایی در پرتو اخلاق زیستی و حقوق عمومی

هدف مقاله حاضر بررسی تاثیر ثبت ارقام گیاهی بر سلامت غذایی در پرتو حقوق عمومی و اخلاق زیسی است. بحث مورد اشاره از از موضوعات مهمی است که می‌تواند محل تعارض و مناقشه میان سلامت غذایی به عنوان یکی از عناضر اخلاق زیستی و در کل به عنوان یک حق عمومی با ثبت ارقام گیاهی از سوی به‌نژادگران باشد. سوال اساسی این است که سازوکارهای توازن و تعادل بخشی میان ثبت ارقام گیاهی و سلامت غذایی در پرتو اخلاق زیستی و حقوق عمومی چیست؟ مقاله پیش رو توصیفی تحلیلی بوده و با استفاده از روش کتابخانه‌ای به بررسی سوال مورد اشاره پرداخته است. نتایج مقاله بیانگر این امر است که هم در حقوق داخلی و هم در اسناد بین المللی در راستای توازن بخشی به حق بر سلامت غذایی به عنوان یکی از ابعاد حقوق عمومی جامعه و حق ثبت ارقام گیاهی به‌نژادگران سازوکارهای مختلف در نظر گرفته شده است. ایجاد شرایط ایمنی جهت انتقال فناوری تغییر ژنتیکی و ارقام گیاهی و آگاه سازی مراجع ذی صلاح، حفظ اسرار مربوط به محصولات تغییر ژنتیک یافته و ارایه اطلاعات صحیح درباره محصولات تغییر ژنتیک یافته از سوی دولت‌ها از جمله سازوکارهای مورد اشاره است. البته در خصوص ضمانت اجرای سازوکارهای مورد اشاره نارسایی‌هایی به ویژه در اسناد بین المللی وجود دارد که رفع آن ضروری است. آنچه به عنوان نتیجه گیری می‌توان مطرح کرد این است که حق بر سلامت هم در حقوق داخلی و هم در اسناد بین المللی مورد تاکید قرار گرفته است اما در حقوق داخلی ایران از ضمانت اجرای قوی تری برخوردار است.
