کارکرد و نقش دولت در تحقق حقوق اقتصادی شهروندان در نظام حقوقی ایران و آمریکا

پژوهش حاضر از نوع بنیادی و با هدف نشان دادن نقش و جایگاه دولت در برآورده کردن حقوق اقتصادی شهروندان از منظر نظام حقوقی ایران و امریکا است. در این نوشتار با روش توصیفی-تحلیلی و ابزار تحلیلی، نقش و جایگاه دولت در ایران و امریکا بر موضوع حقوق اقتصادی شهروندان بررسی شده است. یافتهها نشان داده است که سنت لیبرالی و خصوصی سازی در قالب دولت کمینه یا حداقلی در امریکا، نقش دولت را قالب «تنظیمگری» جلوه داده است. هرچند در انگاره دولت رفاه، نقش دولت پررنگتر میشود و بیشتر بر مبنای مقتضیات جامعه و نه اصول قانون اساسی عملیاتی میشود. اما در ایران، به دلیل پیروی از اصول قانون اساسی، دولت به شکل مؤثری در حقوق اقتصادی شهروندان دارای نقش و اثرگذاری است که باعث تحمیل وظایف دشوار و متعدد برای برآورده کردن حقوق یاد شده دارد. در برخی از اصول قانون اساسی از جمله اصل 29، اغلب حقوق اقتصادی به عهده دولت گذاشته شده است که به دلیل ضعف بخش غیردولتی، برآورده کردن حقوق اقتصادی را دشوار نموده است.
