An Exploration of the Challenges to Judicial Discretion in Criminal Proceedings within the Iranian Legal System (Case Study: Knowledge-Based, Manufacturing, and Industrial Companies)

Abstract

Judicial discretion, as the backbone of judicial independence, plays a decisive role in ensuring fair trial standards and the realization of criminal justice. This study was conducted to identify and analyze the structural and legal challenges affecting judicial discretion within Iran’s criminal justice system, particularly in cases involving knowledge-based, manufacturing, and industrial companies, and to propose reform-oriented solutions. The research adopted a qualitative, interpretive, and comparative approach. Data were collected through systematic content analysis of domestic legal sources, including the Constitution of the Islamic Republic of Iran, the Criminal Procedure Code of 2013, and the Islamic Penal Code, as well as international instruments (particularly the International Covenant on Civil and Political Rights), judicial precedents, and theoretical literature. The data were analyzed using thematic analysis. The findings revealed six principal challenges affecting judicial discretion: legal constraints (including the rigidity of jurisprudential rules and procedural requirements such as Article 48), political and security interventions, lack of procedural transparency, incompatibility with fair trial principles (particularly the right to defense), structural deficiencies (including centralization and non-transparent appointment processes), and educational shortcomings resulting from memory-oriented training approaches. Furthermore, in the context of technological and industrial cases, four specialized challenges were identified: intellectual property disputes, commercial and contractual conflicts, issues relating to production standards and quality control, and regulatory gaps stemming from judges’ insufficient technical expertise. These challenges interact systematically to undermine judicial independence and discretion. By proposing a four-level framework consisting of legislative reforms (including revision of Article 48 and enactment of a Judicial Independence Protection Act), structural reforms (establishment of independent judicial appointment councils), educational transformation (a shift toward competency-based training), and international engagement (effective compliance with the ICCPR), this study offers a comprehensive framework for strengthening criminal justice and ensuring fair trial guarantees within Iran’s legal system.
