ابطال آرای داوری به دلیل مغایرت با نظم عمومی در حقوق ایران و ترکیه

ابطال آرای داوری به دلیل مغایرت با نظم عمومی، یکی از چالش‌برانگیزترین مباحث در حقوق داوری بین‌المللی است. این مقاله با روش تطبیقی-تحلیلی و با استناد به منابع حقوقی، رویه قضایی و دکترین، به بررسی مبانی نظری و مصادیق عملی ابطال آرای داوری در نظام‌های حقوقی ایران و ترکیه می‌پردازد. یافته‌ها نشان می‌دهد که در حقوق ایران، نظم عمومی عمدتاً بر پایه موازین شرعی تعریف می‌شود، در حالی که در حقوق ترکیه، تأثیرپذیری از استانداردهای اتحادیه اروپا و قوانین رقابتی، تفسیر موسع‌تری از نظم عمومی ارائه می‌دهد. تفاوت در مبانی حقوقی، منجر به رویکردهای متفاوت در تفسیر نظم عمومی و دامنه شمول آن شده است. این پژوهش با تحلیل آرای قضایی و اسناد قانونی، راهکارهایی برای کاهش تعارضات پیشنهاد می‌دهد. کاهش تعارضات ناشی از ابطال آرای داوری در ایران و ترکیه، مستلزم ترکیبی از اصلاحات تقنینی، آموزش تخصصی، و فناوری‌های نوین است. در حالی که ترکیه با تکیه بر همگرایی با اتحادیه اروپا گامهای مؤثری برداشته، ایران نیازمند بازتعریف نظم عمومی در چارچوبی متعادلتر است که هم ارزشهای اسلامی را حفظ کند و هم تعهدات بین‌المللی را نادیده نگیرد.
