Journal Article 2024 11 18 <p>Electronic litigation, as an innovative development in the Iranian legal system, has had profound impacts on fundamental principles of due process, such as the right to access justice, transparency, and the expeditious handling of proceedings. While this transformation offers advantages such as reducing trial delays and facilitating access to judicial services, it also presents challenges including the protection of privacy, equitable access to technology, and system security. In order to fully harness the benefits of electronic litigation, it is essential to uphold foundational principles of due process such as the observance of the right to defense, the public nature of trials, and the right to access evidence. This necessitates close cooperation among judicial institutions, legislators, and information technology experts. Additionally, essential measures for achieving fair and effective electronic litigation include training judges and judicial personnel on electronic evidence and cybercrimes, improving technical infrastructure, and promoting public awareness and cultural readiness.</p> <p>دادرسی الکترونیکی به عنوان تحولی نوین در نظام حقوقی ایران، تأثیرات عمیقی بر اصول بنیادین دادرسی مانند حق دسترسی به عدالت، شفافیت و سرعت رسیدگی دارد. این تحول با وجود مزایایی مانند کاهش اطاله دادرسی و تسهیل دسترسی به خدمات قضایی، چالش‌هایی همچون حفظ حریم خصوصی، برابری دسترسی به فناوری و امنیت سیستم‌ها را به همراه دارد. برای بهره‌برداری کامل از مزایای دادرسی الکترونیکی، ضروری است که اصول بنیادین دادرسی مانند رعایت حقوق دفاعی، علنی بودن دادرسی و حق دسترسی به ادله به طور کامل رعایت شوند. این امر نیازمند همکاری بین نهادهای قضایی، قانون‌گذاران و متخصصان فناوری اطلاعات است. همچنین، آموزش قضات و کارکنان قضایی درباره ادله الکترونیکی و جرایم سایبری، بهبود زیرساخت‌های فنی و فرهنگ‌سازی در جامعه از جمله اقدامات ضروری برای تحقق دادرسی الکترونیکی عادلانه و کارآمد است.</p> Electronic Litigation Fundamental Principles of Litigation Iran's Legal System Right to Defense Judicial Transparency Access to Justice Electronic Evidence Cybercrimes Privacy Protection Technical Infrastructure دادرسی الکترونیکی اصول بنیادین دادرسی نظام حقوقی ایران حقوق دفاعی شفافیت قضایی دسترسی به عدالت ادله الکترونیکی حریم خصوصی زیرساخت‌های فنی جرایم سایبری https://jecjl.com/index.php/jecjl/article/download/93/54
