Journal Article 1405 02 14 <p>The jurisprudence of resistance, as an important branch of Islamic jurisprudence, is concerned with elucidating the Sharia rulings and legal principles governing resistance to oppression, the defense of rights, and steadfastness against aggressors. Using a descriptive-analytical method and library-based sources, this study seeks to evaluate and explain a theoretical framework grounded in the doctrine of authentic resistance in Islamic thought for confronting soft warfare and maintaining internal security and stability. The findings indicate that the jurisprudence of resistance rests on robust foundations, including the principle of negation of domination (nafy al-sabil), the principle of preventing hostile infiltration, the obligation to defend the integrity of Islam (defensive jihad), the principle of no harm (la darar), the principle of preserving the social and political order, the principle of justice, and the principle of dignity. Each of these principles has considerable potential for developing a theoretical framework for countering soft threats. The culture of resistance, through such components as opposition to hegemonic domination, a jihad-oriented spirit, and the revitalization of religious identity, also provides a clear perspective for achieving sustainable internal security. The Islamic defense system encompasses three categories of jurisprudential propositions—security-generating rules, security-threatening factors, and the rulings and regulations governing warfare—which together provide a comprehensive framework for safeguarding national security. Accordingly, by offering robust theoretical foundations and practical strategies, the jurisprudence of resistance can serve as an effective roadmap for countering soft warfare and strengthening internal security.</p> <p>فقه مقاومت به عنوان یکی از شاخه‌های مهم فقه اسلامی، عهده‌دار تبیین احکام و قواعد شرعی مرتبط با مقابله با ظلم، دفاع از حق و پایداری در برابر متجاوزان است. این پژوهش در صدد برآمد تا با روش توصیفی تحلیلی و بهره‌گیری از منابع کتابخانه‌ای چارچوب نظری مبتنی بر نظریه مقاومت اصیل در اندیشه اسلامی را در مقابله با جنگ نرم و ثبات امنیت داخلی ارزیابی و تبیین نماید . یافته‌های پژوهش نشانگر آن است که فقه مقاومت دارای مبانی مستحکمی همچون قاعده نفی سبیل، قاعده نفی نفوذ، وجوب دفاع از کیان اسلام (جهاد ذبی)، قاعده لاضرر، قاعده حفظ نظام، اصل عدالت و اصل عزت است که هر یک ظرفیت بالایی برای ایجاد چارچوب نظری مقابله با تهدیدات نرم دارند. فرهنگ مقاومت نیز با مؤلفه‌های استکبارستیزی، روحیه جهادی و احیای هویت دینی، افق روشنی برای رسیدن به امنیت پایدار داخلی ترسیم می‌کند. نظام دفاعی اسلام مشتمل بر سه دسته گزاره فقهی (تولید امنیت، تهدید امنیت و احکام و قوانین جنگ) است که چارچوب جامعی برای صیانت از امنیت ملی ارائه می‌دهد. بدیهی است فقه مقاومت با ارائه مبانی نظری مستحکم و راهبردهای عملیاتی، می‌تواند به عنوان نقشه راهی کارآمد در عرصه مقابله با جنگ نرم و ارتقای امنیت داخلی مورد توجه قرار گیرد.</p> https://jecjl.com/index.php/jecjl/article/download/733/484
