Employing a descriptive-analytical approach and drawing on authoritative international sources and reports issued by human rights organizations, this study examines the conflict from two complementary perspectives: first, an analysis of systematic violations of international humanitarian law (IHL); and second, an evaluation of the performance of the institution responsible for the maintenance of international peace and security, namely the United Nations Security Council. The findings indicate that Israeli military operations during this period were accompanied by serious violations of the fundamental principles of distinction, proportionality, and precaution. At the institutional level, the Security Council, owing to the repeated exercise of the veto by the United States, was effectively unable to adopt any decisive measures to establish a ceasefire. In terms of national sovereignty, despite the weakening of formal structures, the conflict contributed to strengthening a unified national identity among Palestinians. The findings underscore the necessity of structural reforms within international institutions, particularly with regard to the veto power.</p> <p>جنگ ۱۲ روزه غزه (مه ۲۰۲۱) نماد بارز چالش‌های نظام حقوقی بین‌الملل در مواجهه با بحران‌های انسانی است. این پژوهش با رویکردی توصیفی-تحلیلی و با بهره‌گیری از منابع معتبر بین‌المللی و گزارش‌های سازمان‌های حقوق بشری، به واکاوی این جنگ از دو منظر مکمل پرداخته است: نخست، تحلیل نقض‌های سیستماتیک حقوق بشردوستانه (IHL) و دوم، ارزیابی عملکرد نهاد مسئول حفظ صلح، یعنی شورای امنیت. یافته‌ها نشان می‌دهد که عملیات نظامی اسرائیل در این دوره، با نقض فاحش اصول بنیادین تمایز، تناسب و احتیاط همراه بوده است. در سطح نهادی، شورای امنیت به دلیل کاربست مکرر حق وتو توسط ایالات متحده، عملاً در اتخاذ هرگونه اقدام قاطع برای برقراری آتش‌بس ناکام ماند. در بعد حاکمیت ملی، با وجود تضعیف ساختارهای رسمی، این جنگ به تقویت هویت ملی واحد در میان فلسطینیان انجامید. نتایج پژوهش بر ضرورت اصلاحات ساختاری در نهادهای بین‌المللی، به‌ویژه در زمینه حق وتو، تأکید دارد.</p> https://jecjl.com/index.php/jecjl/article/download/723/480
