    <Abstract>&lt;p&gt;The conflict between right and interest is among the most important issues in public law, philosophy of law, and theories of justice in contemporary legal systems. On the one hand, protecting individual rights and guaranteeing freedoms and fundamental rights are regarded as central objectives of every legal system; on the other hand, securing the public interest, maintaining social order, and realizing collective welfare are also undeniable necessities. The main problem of this study is to identify the criteria of legitimacy in cases of conflict between right and interest and to examine the possibility of extracting a common framework from Imamiyyah jurisprudence, Iranian positive law, and the common law system. Using a descriptive-analytical method and a comparative approach, the present study examines the theoretical and practical foundations governing the relationship between right and interest in the three legal systems under study. The findings indicate that, despite differences in epistemological foundations, legal sources, and modes of reasoning, all three systems emphasize principles such as justice, necessity, limitation of power, protection of fundamental rights, reviewability, and accountability, and none of them supports the absolute priority of either right or interest. Based on the findings, a six-criterion model of legitimacy is proposed, including legitimacy of aim, necessity, proportionality, reviewability, accountability, and preservation of the core content of fundamental rights. By drawing on the common elements found in Imamiyyah jurisprudence, Iranian law, and the common law system, this model provides an analytical framework for assessing legitimacy in cases of conflict between right and interest. The main contribution of the study is the presentation of a mediating and balancing model that can be used in the analysis of legislation, administrative decisions, public policies, and judicial rulings, while enabling simultaneous protection of individual rights and the public interest.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;تعارض میان حق و منفعت از مهم‌ترین مسائل حقوق عمومی، فلسفه حقوق و نظریه عدالت در نظام‌های حقوقی معاصر به شمار می‌رود. از یک سو، حمایت از حقوق اشخاص و تضمین آزادی‌ها و حقوق بنیادین، از اهداف اصلی هر نظام حقوقی محسوب می‌شود و از سوی دیگر، تأمین منافع عمومی، حفظ نظم اجتماعی و تحقق مصالح جمعی نیز ضرورتی انکارناپذیر است. مسئله اصلی این پژوهش، شناسایی معیارهای مشروعیت در موارد تعارض میان حق و منفعت و بررسی امکان استخراج چارچوبی مشترک از فقه امامیه، حقوق موضوعه ایران و نظام کامن‌لا است. پژوهش حاضر با روش توصیفی ـ تحلیلی و با بهره‌گیری از رویکرد تطبیقی، مبانی نظری و عملی حاکم بر رابطه حق و منفعت را در سه نظام حقوقی مورد مطالعه بررسی کرده است. نتایج پژوهش نشان می‌دهد که علی‌رغم تفاوت‌های موجود در مبانی معرفتی، منابع حقوقی و شیوه‌های استدلال، هر سه نظام بر اصولی همچون عدالت، ضرورت، محدودسازی قدرت، حمایت از حقوق بنیادین، نظارت‌پذیری و پاسخگویی تأکید دارند و هیچ‌یک از آن‌ها از تقدم مطلق حق یا منفعت حمایت نمی‌کنند. بر اساس یافته‌های پژوهش، مدل شش‌معیاره مشروعیت شامل مشروعیت هدف، ضرورت، تناسب، نظارت‌پذیری، پاسخگویی و حفظ هسته سخت حقوق بنیادین ارائه شده است. این مدل با بهره‌گیری از عناصر مشترک موجود در فقه امامیه، حقوق ایران و نظام کامن‌لا، چارچوبی تحلیلی برای ارزیابی مشروعیت در موارد تعارض حق و منفعت فراهم می‌آورد. دستاورد اصلی پژوهش، ارائه الگویی میانجی و تعادلی است که می‌تواند در تحلیل قوانین، تصمیمات اداری، سیاست‌های عمومی و آرای قضایی مورد استفاده قرار گیرد و زمینه حمایت هم‌زمان از حقوق اشخاص و منافع عمومی را فراهم سازد.&lt;/p&gt;</OtherAbstract>
