Journal Article 1401/11/01 <p>With the expansion of intelligent systems, the possibility of data analysis and decision recommendation in the adjudicative process has emerged. However, how can the position of the human judge and the Sharia-based criteria of knowledge, justice, and accountability in Islamic jurisprudence be adapted to this transformation? The main question is to what extent the function of artificial intelligence in adjudication is acceptable from a jurisprudential perspective, and what limits it entails. Using a descriptive–analytical method, the present study concludes that, based on jurisprudential evidence, artificial intelligence has no position as an independent judge; however, it can play a facilitative role as a judicial assistant under the supervision of a human judge. To confront future developments, Imami jurisprudence must, through the redefinition of fundamental concepts and the strengthening of interdisciplinary research, and while formulating precise ethical and legal regulations, employ this technology as a platform for the more objective realization of justice and the fulfillment of Sharia-based responsibilities in line with the lofty ideals of Islam.</p> <p>با گسترش سامانه‌های هوشمند، امکان تحلیل داده‌ها و پیشنهاد تصمیم در فرایند قضاوت مطرح شده است، اما جایگاه قاضیِ انسان و معیارهای شرعیِ علم، عدالت و مسئولیت‌پذیری در فقه چگونه بر این تحول انطباق می‌یابد؟ سؤال اصلی این است که کارکرد هوش مصنوعی در قضاوت از منظر فقهی تا چه حد پذیرفتنی است و چه حدودی دارد؟ تحقیق حاضر با روش توصیفی – تحلیلی به این نتیجه دست یافته است که بر اساس ادله فقهی، هوش مصنوعی به عنوان قاضی مستقل جایگاهی ندارد، اما می‌تواند به عنوان دستیار قضایی تحت نظارت قاضی انسان، نقشی تسهیل‌گر داشته باشد. برای مواجهه با تحولات آینده، فقه امامیه باید با بازتعریف مفاهیم بنیادین و تقویت پژوهش‌های بین‌رشته‌ای، ضمن تدوین ضوابط اخلاقی و حقوقی دقیق، از این فناوری به مثابه بستری برای تحقق عینی‌تر عدالت و ادای مسئولیت‌های شرعی در راستای آرمان‌های متعالی اسلامی بهره گیرد.</p> https://jecjl.com/index.php/jecjl/article/download/640/350
