The expansion of communication technologies, ease of internet access, and development of electronic payment instruments have caused this phenomenon to emerge on a large scale, often with transnational characteristics. The present study, adopting a descriptive–analytical approach, examines the possibility of committing crimes such as fraud, money laundering, and unlawful acquisition of property through internet lottery platforms, while also attempting to analyze the legal status of this phenomenon within the Iranian criminal justice system. In this regard, the study first investigates the fundamental characteristics of internet lotteries, including their basis in games of chance, dependence on technical instruments, transnational nature, necessity of financial value transfer, and the absence of direct participant involvement in the process of determining winners. Subsequently, the criminalization of behaviors associated with internet lotteries under Iranian criminal law is analyzed, including agreements for gambling, participation in lotteries, organization of prize drawings, establishment and management of virtual platforms, as well as the production and support of related technological tools. The findings indicate that although Iranian criminal law does not recognize an independent criminal title specifically for “internet lottery,” a range of related criminal offenses may encompass various forms of conduct in this field. The study further demonstrates that, under certain circumstances, internet lottery may serve as a means for perpetrating fraud or unlawful acquisition of property, and in legal systems where gambling is lawful, it may even provide opportunities for exploitation in money laundering processes.</p> <p>لاتاری اینترنتی به‌عنوان یکی از جلوه‌های نوین بخت‌آزمایی در بستر فضای مجازی، به دلیل اتکای آن به شانس، پرداخت مالی و ساختار دیجیتال، از منظر حقوق کیفری و جرایم مالی اهمیت ویژه‌ای یافته است. گسترش فناوری‌های ارتباطی، سهولت دسترسی به اینترنت و توسعه ابزارهای پرداخت الکترونیکی موجب شده است که این پدیده در مقیاس گسترده و غالباً با ویژگی‌های فرامرزی شکل گیرد. پژوهش حاضر با رویکردی توصیفی ـ تحلیلی به بررسی امکان ارتکاب جرایمی نظیر کلاهبرداری، پولشویی و تحصیل مال از طریق نامشروع در بستر لاتاری اینترنتی پرداخته و تلاش کرده است جایگاه این پدیده را در نظام کیفری ایران تحلیل کند. در این راستا ابتدا ویژگی‌های اساسی لاتاری اینترنتی از جمله ابتنا بر بازی مبتنی بر شانس، نیازمندی به ابزارهای فنی، ماهیت فرامرزی، ضرورت انتقال ارزش مالی و عدم مشارکت مستقیم شرکت‌کنندگان در فرآیند تعیین برنده مورد بررسی قرار گرفته است. سپس نحوه جرم‌انگاری رفتارهای مرتبط با آن در قوانین کیفری ایران از جمله توافق برای بخت‌آزمایی، شرکت در لاتاری، برگزاری قرعه‌کشی، تأسیس و اداره بسترهای مجازی و همچنین تولید و پشتیبانی ابزارهای مربوط تحلیل شده است. یافته‌های پژوهش نشان می‌دهد که اگرچه عنوان مجرمانه مستقلی برای «لاتاری اینترنتی» در حقوق کیفری ایران پیش‌بینی نشده است، اما مجموعه‌ای از جرایم مرتبط می‌توانند رفتارهای مختلف در این حوزه را تحت پوشش قرار دهند. همچنین مشخص گردید که لاتاری اینترنتی در شرایطی خاص می‌تواند به‌عنوان وسیله‌ای برای تحقق کلاهبرداری یا تحصیل مال از طریق نامشروع مورد استفاده قرار گیرد و در نظام‌های حقوقی که بخت‌آزمایی قانونی است حتی ظرفیت بهره‌برداری در فرآیندهای پولشویی را نیز دارد.</p> https://jecjl.com/index.php/jecjl/article/download/589/344
