In this context, interaction between the police and the judiciary, as the two principal institutions involved in preliminary investigations, is considered a fundamental factor in enhancing the efficiency, speed, and legitimacy of the crime detection process. The purpose of this article is to examine the existing challenges in police–judiciary interaction and to propose strategies for improving such interaction in the crime detection process. Using a descriptive–analytical approach and relying on library resources, criminological theories, policing studies, and criminal justice literature, the article analyzes the organizational dimensions of interaction between the police and judicial authorities. The findings indicate that ambiguity regarding institutional powers, lack of joint professional training, absence of integrated information systems, insufficient documentation standards, dominance of hierarchical approaches, and weak organizational trust are among the major barriers to effective interaction between the two institutions. The results further demonstrate that improving interaction requires simultaneous reforms in legal, organizational, educational, technological, and cultural domains. Accordingly, the article proposes strategies such as drafting a comprehensive procedural framework for interaction in criminal investigations, establishing specialized joint working groups, developing integrated information systems, standardizing police reports and judicial orders, expanding joint professional training programs, and strengthening specialized policing structures. Ultimately, the article concludes that a structured, accountable, and expertise-oriented interaction between the police and the judiciary can improve the quality of crime detection, reduce procedural delay, increase evidentiary reliability, enhance protection of citizens’ rights, and strengthen public trust in the criminal justice system.</p> <p>فرآیند جرم‌یابی به‌عنوان یکی از مهم‌ترین مراحل نظام عدالت کیفری، نقش تعیین‌کننده‌ای در کشف حقیقت، شناسایی مرتکبان، حفظ ادله و تحقق عدالت دارد. در این میان، تعامل میان پلیس و دستگاه قضایی به‌عنوان دو نهاد اصلی در تحقیقات مقدماتی، از عوامل اساسی در افزایش کارآمدی، سرعت و مشروعیت فرآیند کشف جرم محسوب می‌شود. هدف این مقاله، بررسی چالش‌های موجود در تعامل پلیس و دستگاه قضایی و ارائه راهکارهایی برای ارتقای این تعامل در فرآیند جرم‌یابی است. مقاله حاضر با رویکردی تحلیلی ـ توصیفی و با استفاده از منابع کتابخانه‌ای، نظریه‌های جرم‌شناسی، مطالعات پلیسی و ادبیات عدالت کیفری به بررسی ابعاد مختلف تعامل سازمانی میان پلیس و دستگاه قضایی پرداخته است. یافته‌ها نشان می‌دهد که عواملی نظیر ابهام در حدود اختیارات، ضعف آموزش مشترک، نبود سامانه‌های اطلاعاتی یکپارچه، فقدان استانداردهای مشترک در مستندسازی، غلبه رویکرد سلسله‌مراتبی و ضعف اعتماد سازمانی از مهم‌ترین موانع تعامل مؤثر میان این دو نهاد هستند. همچنین نتایج حاکی از آن است که ارتقای تعامل نیازمند اصلاحات هم‌زمان در حوزه‌های حقوقی، سازمانی، آموزشی، فناورانه و فرهنگی است. بر این اساس، راهکارهایی مانند تدوین آیین‌نامه جامع تعامل در جرم‌یابی، تشکیل کارگروه‌های مشترک تخصصی، طراحی سامانه‌های اطلاعاتی مشترک، استانداردسازی گزارش‌های پلیسی و دستورهای قضایی، توسعه آموزش‌های مشترک و تقویت پلیس تخصصی پیشنهاد شده است. در نهایت، مقاله نتیجه می‌گیرد که تعامل ساختارمند، پاسخگو و تخصص‌محور میان پلیس و دستگاه قضایی می‌تواند علاوه بر ارتقای کیفیت جرم‌یابی، موجب کاهش اطاله دادرسی، افزایش اعتبار ادله، حمایت بهتر از حقوق شهروندی و تقویت اعتماد عمومی به نظام عدالت کیفری شود.</p> https://jecjl.com/index.php/jecjl/article/download/575/421
