Journal Article 1404/04/01 <p>The purpose of this article is to examine religious government and the manner of legitimacy and acceptability in the political views of Mohammad Mojtahed Shabestari. The main question of this article seeks to answer: What is Shabestari’s thought and perspective regarding religious government? The research hypothesis is that temporal and spatial conditions, along with differing ideologies, have led to a distinct interpretation of religion and religious government in Shabestari’s view. The findings of the study show that, from Shabestari’s perspective, legitimacy and acceptability are obtained through the people’s choice and the exercise of the rights of all members of society. He regards democracy as a form of lawful governance, yet he considers legitimacy and acceptability to be derived from the divine legislator, and he accepts the notion of Islamic democracy. Furthermore, he believes in the existence of velayat-e faqih (Guardianship of the Islamic Jurist) within society. The present research is conducted using Quentin Skinner’s intentional hermeneutic method. The method of data collection in this study is documentary and library-based.</p> <p>هدف این مقاله بررسی حکومت دینی، نحوه مشروعیت و مقبولیت در آراء سیاسی محمد مجتهد شبستری می‌باشد. سوال اصلی این مقاله در پی پاسخ به انست که <strong> </strong>اندیشه و آراء شبستری نسبت  به حکومت دینی چیست؟ فرضیه تحقیق بدین صورت است که <strong> </strong>شرایط زمانی و مکانی و ایدئولوژی متفاوت سبب برداشت متفاوت از دین و حکومت دینی در نگاه شبستری شده است. یافته‌های تحقیق نشان می‌دهد از نظر شبستری مشروعیت و مقبولیت، از طریق انتخاب مردم و اعمال حقوق همه افراد جامعه  بدست می‌آید. ایشان دموکراسی را شیوه حکومت قانونمد می‌داند ولی مشروعیت و مقبولتی را از طریق شارع مقدس می‌داند و دموکراسی اسلامی را قبول دارد.و وجود به ولایت فقیه  در جامعه معتقد است. پژوهش حاضر با   استفاده از روش هرمنوتیک قصد گرای اسکینر انجام می‌شود. شیوه جمع آوری داده‌ها نیز در این پژوهش به صورت اسنادی و کتابخانه‌ای است.</p> https://jecjl.com/index.php/jecjl/article/download/333/239
