    <Abstract>&lt;p&gt;Filtering, as one of the state’s main control mechanisms in cyberspace, has had profound consequences for online businesses in Iran. This article examines the basis of state civil liability for the closure of online businesses caused by filtering, analyzing the economic, social, cultural, and legal dimensions of this phenomenon. Findings reveal that filtering leads to severe revenue losses, startup closures, rising unemployment, and reduced domestic and foreign investment. On the social and cultural side, public trust in government declines, digital migration increases, and citizens’ intellectual property rights are infringed. Legally, filtering results in violations of fundamental rights such as job security, free access to information, and the right to property. The theoretical analysis shows that although Iranian law distinguishes between sovereign and proprietary acts, such a division is ineffective in cyberspace, and the state remains liable even for sovereign actions. Theories of fault, risk, and guarantee of rights all highlight the necessity of state accountability. However, compensation faces significant challenges, including legal ambiguities, broad governmental immunity, weak enforcement mechanisms, absence of compensation funds, and financial limitations. The study concludes that achieving effective state liability for the impacts of filtering requires legislative reform, institutional mechanisms, and the adoption of accountability as a guiding principle of digital governance.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;فیلترینگ به‌عنوان یکی از ابزارهای کنترلی دولت در فضای مجازی، در ایران پیامدهای گسترده‌ای بر کسب‌وکارهای اینترنتی بر جای گذاشته است. این مقاله با هدف بررسی مبنای مسئولیت مدنی دولت در قبال تعطیلی کسب‌وکارهای اینترنتی ناشی از فیلترینگ، به تحلیل ابعاد اقتصادی، اجتماعی، فرهنگی و حقوقی این پدیده پرداخته است. یافته‌ها نشان می‌دهد که فیلترینگ موجب کاهش شدید درآمد، تعطیلی استارتاپ‌ها، افزایش بیکاری و کاهش سرمایه‌گذاری داخلی و خارجی می‌شود. در بعد اجتماعی و فرهنگی، اعتماد عمومی به دولت کاهش یافته، مهاجرت دیجیتال افزایش یافته و حق مالکیت معنوی شهروندان نقض می‌شود. از منظر حقوقی نیز، فیلترینگ به تضییع حقوق اساسی همچون امنیت شغلی، دسترسی آزاد به اطلاعات و حق مالکیت منجر می‌گردد. بررسی مبانی نظری نشان داد که گرچه در حقوق ایران تفکیک میان اعمال حاکمیتی و تصدی‌گرایانه وجود دارد، اما در حوزه فضای مجازی این مرزبندی پاسخگو نیست و دولت حتی در اقدامات حاکمیتی نیز ملزم به جبران خسارت است. نظریه‌های تقصیر، خطر و تضمین حق همگی بر ضرورت مسئولیت‌پذیری دولت تأکید دارند. با این حال، جبران خسارت در عمل با چالش‌هایی همچون ابهام در قوانین، مصونیت گسترده دولت، ضعف ضمانت اجراها، نبود صندوق جبران خسارت و محدودیت منابع مالی مواجه است. نتیجه‌گیری مقاله آن است که تحقق واقعی مسئولیت مدنی دولت در قبال آثار فیلترینگ مستلزم بازنگری قوانین، ایجاد سازوکارهای نهادی و پذیرش اصل پاسخگویی در حکمرانی دیجیتال است.&lt;/p&gt;</OtherAbstract>
