Employing an analytical–argumentative method, the research analyzes the points of convergence, divergences, and practical applications of these two domains. Among the commonalities, the alignment of rules of verbal indication and contextual evidence in uṣūl al-fiqh with hermeneutics’ emphasis on historical context and textual clues (such as the interpretation of Qur’an 2:185), as well as the role of the dialectic between text and reader, is particularly notable. However, fundamental differences include the stability-oriented framework of uṣūl al-fiqh, which underscores the intent of the author (God or the Prophet), in contrast to the dynamism and multiplicity of meanings in hermeneutics, with historical horizons posing challenges to the authority of apparent meanings. Practical applications include the use of Jauss’s (1982) concept of the “horizon of expectation” to refine contextual evidence, the application of Iser’s (1978) notion of the reader’s active role in interpretation while maintaining the framework of authority, and the proposal of an integrative model combining dynamic interpretation with traditional rules that can contribute to dynamic ijtihād in contemporary issues such as biotechnology and the environment. Challenges and limitations—including the tension between the stability of rulings and multiplicity of meanings, the influence of globalization and cultural pluralism on the acceptance of hermeneutical approaches, and the necessity of preserving religious authenticity—are addressed through strategies such as integrative frameworks, jurisprudential oversight, and interdisciplinary education. Recent findings, drawing on advances in neo-hermeneutics and new comparative data from studies in Al-Azhar and Tehran, highlight the potential of integration for a deeper understanding of religious texts. The conclusion indicates that hermeneutics, while preserving the authority of apparent meanings and consensus, can enrich the understanding of texts and respond to contemporary needs, provided that frameworks are designed to ensure a balance between innovation and tradition.</p> <p>این پژوهش با هدف بررسی تطبیقی حجیت ظواهر کتاب و سنت در اصول فقه با مفاهیم پیشرفته هرمنوتیک مدرن انجام شده است. با بهره‌گیری از روش تحلیلی-استدلالی، این مطالعه نقاط اشتراک، تفاوت‌ها، و کاربردهای عملی این دو حوزه را مورد تحلیل قرار داده است. از جمله نقاط اشتراک، هم‌راستایی قواعد دلالت لفظی و قرائن محیطی در اصول فقه با تأکید هرمنوتیک بر زمینه تاریخی و قرائن متنی (مانند تفسیر آیه 185 سوره بقره) و نقش دیالکتیک متن و خواننده برجسته است. با این حال، تفاوت‌های بنیادین شامل ثبات‌محوری اصول فقه که بر مراد مؤلف (خداوند یا پیامبر) تأکید دارد، در مقابل پویایی و تکثر معانی در هرمنوتیک، و چالش‌هایی برای حجیت ظواهر ناشی از افق‌های تاریخی مشاهده می‌شود. کاربردهای عملی شامل استفاده از مفهوم «افق انتظار» ژاس (1982) برای تعدیل قرائن محیطی، بهره‌گیری از نقش فعال خواننده ایسر (1978) در تفسیر با حفظ چارچوب حجیت، و ارائه مدل تلفیقی مبتنی بر تأویل پویا و قواعد سنتی است که می‌تواند به اجتهاد پویا در مسائل معاصر مانند زیست‌فناوری و محیط‌زیست کمک کند. چالش‌ها و محدودیت‌ها، از جمله تعارض بین ثبات احکام و تکثر معانی، تأثیر جهانی‌سازی و تکثر فرهنگی بر پذیرش رویکردهای هرمنوتیکی، و نیاز به حفظ اصالت دینی، با راهکارهایی مانند چارچوب‌های تلفیقی، نظارت فقهی، و آموزش میان‌رشته‌ای مورد بررسی قرار گرفته است. یافته‌های نوین با تکیه بر پیشرفت‌های نوهرمنوتیکی و داده‌های تطبیقی جدید از مطالعات الازهر و تهران، پتانسیل تلفیق برای فهم عمیق‌تر متون دینی را نشان می‌دهد. نتیجه‌گیری حاکی از آن است که هرمنوتیک، با حفظ حجیت ظواهر و اجماع، می‌تواند به غنی‌سازی فهم متون و پاسخگویی به نیازهای معاصر کمک کند، مشروط به طراحی چارچوب‌هایی که تعادل بین نوآوری و سنت را تضمین کند.</p> https://jecjl.com/index.php/jecjl/article/download/287/201
