One of the most significant aspects of this relationship involves legal disputes between the two countries, which have expanded following the Islamic Revolution of Iran and the continued state of hostile relations. The present article examines the damage determination regime in legal disputes between Iran and the United States and analyzes the impact of these disputes on their bilateral relations. The central research question is: how have legal disputes and the rulings issued by international judicial bodies—particularly the International Court of Justice (ICJ) and arbitral tribunals—affected the relationship between Iran and the United States? This study employs a qualitative analytical methodology, focusing on the examination of international legal documents, judgments of judicial bodies, and authoritative legal sources, while assessing their political and legal ramifications. The findings indicate that the legal disputes between the two countries—including issues such as human rights violations, terrorism, property confiscation, and military attacks—have contributed to heightened hostility and the deterioration of bilateral relations. Moreover, the United States’ failure to enforce legal rulings and its political interference have further complicated bilateral ties and expanded the scope of new legal claims in both domestic and international courts.</p> <p>روابط ایران و ایالات متحده در طول چند دهۀ اخیر تحت تأثیر منازعات سیاسی و حقوقی متعددی قرار گرفته است. یکی از مهم‌ترین جنبه‌های این روابط، دعاوی حقوقی میان دو کشور است که پس از انقلاب اسلامی ایران و تداوم روابط خصمانه، گسترش یافته است. مقاله حاضر به بررسی رژیم تعیین خسارت در دعاوی حقوقی بین ایران و آمریکا می‌پردازد و به تحلیل تأثیر این دعاوی بر روابط دوجانبه دو کشور می‌پردازد. سؤال اصلی تحقیق این است که چگونه دعاوی حقوقی و احکام صادره از مراجع قضائی بین‌المللی، به‌ویژه دیوان بین‌المللی دادگستری و دیوان داوری، بر روابط میان ایران و آمریکا تأثیر گذاشته است؟ روش تحقیق از نوع تحلیل کیفی است که به بررسی اسناد بین‌المللی، رأی‌های دیوان‌های قضائی و منابع معتبر حقوقی پرداخته و تأثیرات سیاسی و حقوقی آن را تجزیه و تحلیل می‌کند. یافته‌ها نشان می‌دهد که دعاوی حقوقی میان دو کشور، که شامل موضوعاتی همچون نقض حقوق بشر، تروریسم، مصادره اموال و حملات نظامی است، باعث افزایش خصومت‌ها و تیره‌گی روابط دو کشور شده است. همچنین، عدم اجرای احکام حقوقی و دخالت‌های سیاسی ایالات متحده موجب پیچیدگی بیشتر روابط دوجانبه و گسترش دامنه دعاوی حقوقی جدید در محاکم داخلی و بین‌المللی شده است.</p> https://jecjl.com/index.php/jecjl/article/download/164/89
