Journal Article 1403/06/28 <p>The present study examines the issue of conflict of interest in the husband's prohibition of the wife's employment. According to Article 1117 of the Civil Code, a husband may prevent his wife from engaging in a profession or industry that is contrary to the interests of the family or the dignity of himself or his wife. However, the implementation of Article 1117 of the Civil Code in certain cases suggests a potential conflict of interest, such that it raises the concern that a husband might exploit the right granted to him under this article to act beyond its intended scope and misuse it for his own personal benefit. The primary question of this study is: In the event that a conflict of interest arises in connection with the application of Article 1117 of the Civil Code, against whom does the husband bear civil liability? The preliminary response that comes to mind is that the husband appears to be liable not only to the wife but also to third parties, provided that the three essential elements of civil liability are established. This study, using a descriptive-analytical method, seeks to assess the relationship between conflict of interest and the husband's prohibition of the wife's employment. It aims to examine the civil liability of the husband in preventing his wife from working in light of the existence of a conflict of interest, and to explain the resulting legal effects and implications.</p> <p>پژوهش حاضر به بررسی تعارض منافع در منع اشتغال زوجه می‌پردازد. مطابق ماده ۱۱۱۷ قانون مدنی شوهر می‌تواند زن خود را از حرفه یا صنعتی که منافی مصالح خانوادگی یا حیثیات خود یا زن باشد منع کند. از سوی دیگر اعمال مفاد ماده ۱۱۱۷ قانون مدنی در برخی از موارد نوعی از تعارض منافع را به ذهن متصور می‌نماید به گونه‌ای که ظن این امر می‌رود که زوج بتواند با استفاده از حقی که ماده موصوف برای وی در نظر گرفته است فراتر از آن عمل نموده و عملا از ماده ۱۱۱۷ قانون مدنی در جهت منافع شخصی خود سو استفاده نماید. پرسش اصلی پژوهش حاضر آن است که در صورت تحقق تعارض منافع در ارتباط با اعمال مفاد ماده ۱۱۱۷ قانون مدنی زوج در برابر چه کسانی مسئولیت مدنی خواهد داشت؟ پاسخی که اجمالاً به ذهن می‌رسد آن است که به نظر می‌رسد زوج هم در برابر زوجه و هم اشخاص ثالث در صورت تحقق عناصر و مولفه‌های سه گانه مسئولیت مدنی، مسئولیت خواهد داشت. پژوهش حاضر بر آن است در چارچوب روش توصیفی تحلیلی ضمن نسبت سنجی تعارض منافع و منع اشتغال زوجه از سوی زوج به مسئولیت مدنی زوج در منع زوجه از اشتغال در پرتو تعارض منافع پرداخته و آثار و پیامدهای حقوقی آن را توضیح دهد.</p> https://jecjl.com/index.php/jecjl/article/download/118/63
